By accessing or using esamarkets.com (the "Site") or submitting information through our buyer, seller, or contact forms, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Site.

Nature of Our Services

ESA Markets operates as an independent brokerage and connector facilitating introductions between buyers and sellers of crude oil, refined fuels, and other commodities. We do not take title to any product, act as a refinery, terminal operator, financial institution, or shipping line, and we are not a party to any sale and purchase agreement, financing arrangement, or other contract entered into between buyers and sellers we introduce.

Submitting a buyer requirement or seller offer through our forms does not guarantee an introduction, a match, or the successful completion of any transaction. ESA Markets exercises discretion in determining which inquiries to pursue and which introductions to facilitate.

No Guarantee of Outcomes

ESA Markets applies a screening and verification process to inquiries submitted through the Site, but this process does not guarantee the legitimacy, solvency, or performance of any buyer, seller, or counterparty. Any transaction entered into following an introduction facilitated by ESA Markets is solely between the relevant principals, who are responsible for conducting their own due diligence, negotiating terms, and fulfilling any resulting contractual obligations.

ESA Markets is not liable for any loss, damage, or dispute arising from a transaction between parties we have introduced, including but not limited to non-performance, fraud, misrepresentation, or breach of contract by either party.

User Responsibilities

By submitting information to ESA Markets, you represent that the information provided is accurate and that you have the authority to submit it on behalf of any company you represent. You agree not to use the Site to submit false, misleading, or fraudulent buyer requirements or seller offers, and not to use information obtained through an ESA Markets introduction for any purpose other than evaluating a genuine commercial transaction.

Fees and Commission

Submitting a buyer requirement or seller offer through the Site is free of charge. Where a brokerage commission applies to a facilitated transaction, this is agreed separately between the relevant parties, typically documented through a standard fee protection agreement, and is not a condition of using the Site or submitting an inquiry.

Intellectual Property

All content on the Site, including text, graphics, logos, and design elements, is the property of ESA Markets or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent.

Third-Party Links and Services

The Site may use third-party services (such as form-processing providers) to operate certain features, including our inquiry forms. We are not responsible for the practices or content of third-party services beyond our reasonable control.

Limitation of Liability
